The following terms govern your use of Your Mortgage Toolbox software and content. By using this site, you agree to these conditions.

1. Your use of this site, calculators, and content is at your own risk. Always consult licensed professionals for financial decisions.
2. All information is provided "as is" without warranties of any kind. We do not guarantee accuracy, timeliness, or uninterrupted access.
3. We are not liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use the software, content, or website.
4. You may not reproduce, resell, distribute, embed, or reverse-engineer our software, calculators, guides, or site content without express written permission.
5. This content is for personal, non-commercial use only unless you have a written license from us.
6. Your Mortgage Toolbox and its licensors retain all intellectual property rights, including copyrights, trademarks, and trade secrets.
7. Unauthorized iframe embedding of any page or calculator on a third-party site is prohibited and is technically blocked.
8. Licensing inquiries (for real estate professionals, lenders, and others who wish to embed or feature our calculators) should be directed to info@yourmortgagetoolbox.com.
9. This agreement is governed by the laws of the State of Texas. Any disputes must be settled in Tarrant County, Texas courts.
10. Violation of these terms may result in denied access to the site and may give rise to civil or criminal liability.
11. You agree to indemnify and hold us harmless from any claims arising from your violation of these terms.
12. If any provision of these terms is found unenforceable, the remaining provisions remain in full effect.
13. We reserve the right to modify these terms at any time. The most recent version is always posted at this URL.

Effective Date: May 9, 2026

Commercial License Terms — Paid Subscribers
If you have purchased a subscription to embed Your Mortgage Toolbox calculators on your website, the following additional terms govern your license. These terms supplement and do not replace the General Terms above.

1. License Grant. Subject to your active paid subscription, Your Mortgage Toolbox grants you a limited, non-exclusive, non-transferable license to embed the licensed calculators on the number of authorized domains specified by your plan: one (1) domain for Individual Pro; up to three (3) domains for Team / Office; as specified in a written agreement for Enterprise.
2. Authorized Domains. You must register your authorized domain(s) with us at the time of account setup. Your embed code is valid only for those registered domains. Use on additional or unregistered domains requires a plan upgrade or a separate written agreement.
3. No Sublicensing or Transfer. You may not share, resell, sublicense, gift, or otherwise transfer your embed code or subscription access to any third party. Each subscriber must maintain their own active subscription.
4. Attribution. Individual Pro and Team / Office subscriptions retain "Powered by Your Mortgage Toolbox" attribution on all calculator pages. Enterprise subscribers may remove attribution only if expressly permitted in their written agreement.
5. Permitted Customization. You may configure brand colors, upload your logo (where included in your plan), and adjust market fee settings through the tools and instructions we provide. You may not modify, decompile, reverse-engineer, or create derivative works from the underlying calculator code.
6. Prohibited Uses. The licensed calculators may not be embedded on websites that promote illegal activities, contain adult or otherwise harmful content, or engage in any activity that violates applicable local, state, federal, or international law.
7. Subscription & Renewal. Subscriptions are billed on the cycle you select at checkout (monthly or annual) and renew automatically until cancelled. You may cancel at any time by emailing info@yourmortgagetoolbox.com; cancellation takes effect at the end of the current paid billing period, and no partial-period refunds are issued except as provided in the Refund Policy below.
8. Refund Policy. You may request a full refund within thirty (30) days of your initial subscription purchase by emailing us. Refunds are not issued after thirty (30) days or on any renewal charges. Refunds for Enterprise engagements are governed by the written agreement for that engagement.
9. Termination for Cause. We may terminate your license immediately, without refund, if you violate any provision of these terms. Upon termination for any reason, you must promptly remove all embed codes from your websites. We reserve the right to deactivate embed codes remotely upon termination.
10. No Warranty on Calculator Accuracy. Calculator outputs are estimates intended to help clients plan and prepare — they are not guaranteed to match actual lender quotes, closing cost disclosures, or other financial figures. You are solely responsible for communicating appropriate disclaimers to your clients and for any reliance they place on calculator results.
11. Limitation of Liability. Our total cumulative liability to you under any commercial license shall not exceed the total subscription fees you paid in the twelve (12) months immediately preceding the claim.
12. Governing Law. These Commercial License Terms are governed by the laws of the State of Texas. Any disputes shall be resolved in the courts of Tarrant County, Texas.

Effective Date: May 14, 2026

Mobile App License Terms — Branded App Subscribers
These terms govern your subscription to the Your Mortgage Toolbox Branded Mobile App ("Branded App") and supplement, and do not replace, the General Terms above.

1. License Grant. Subject to your active paid subscription and payment of the applicable setup fee, Your Mortgage Toolbox grants you a limited, non-exclusive, non-transferable license to distribute one (1) branded instance of the app, configured with your name, photo, contact information, and selected brand colors, via your unique download link and QR code, for download by your clients and prospective clients at no charge to them.
2. Branding Content License. You represent and warrant that you own or have the right to use your submitted name, title, company name, photo, and any other branding content you provide, and you grant Your Mortgage Toolbox a limited license to display that content within your branded app instance and associated marketing materials for as long as your subscription remains active.
3. Setup Fee. The one-time setup fee covers configuration and delivery of your branded app instance and is non-refundable once your branded app has been delivered, except as required by applicable law.
4. Annual Subscription. Your annual subscription covers continued hosting, maintenance, and support of your branded app instance and renews automatically each year at the then-current rate unless cancelled. You may cancel at any time by emailing info@yourmortgagetoolbox.com; cancellation takes effect at the end of the current paid subscription period. Upon non-renewal or cancellation, your branded app link and QR code will be deactivated and will no longer function for new downloads. Clients who already downloaded your branded app may retain access to previously downloaded functionality at our discretion, without ongoing support.
5. Configuration Changes. Your subscription includes three (3) complimentary configuration change requests (e.g., updates to contact information, links, or color scheme) over the life of your subscription. Additional configuration changes are billed at our then-current rate. We target a 24–48 hour turnaround for configuration changes but do not guarantee a specific completion time.
6. AI Assistant (Mo). Your branded app includes Mo, an AI chat assistant powered by OpenAI, that responds to general mortgage questions from your clients. Mo's responses are for general educational purposes only, do not constitute financial, legal, or lending advice, and are not guaranteed to be accurate or complete. You are responsible for ensuring your clients understand this limitation. Neither you nor Your Mortgage Toolbox controls the specific content of Mo's responses, which are generated by third-party AI technology.
7. Third-Party App Store Terms. Distribution of the app and its use by your clients is additionally governed by the applicable terms of service of the Apple App Store, Google Play, and/or Amazon Appstore. In the event of a conflict between those terms and this Agreement as to end-user rights, the applicable app store's terms will govern solely as to that app store's platform requirements.
8. No Guarantee of Store Approval or Availability. We do not guarantee that any app store will approve, list, or continue to list the app, and we are not liable for any app store's decision to remove, restrict, or reject the app or any branded instance of it.
9. Prohibited Uses. The same restrictions as Section 6 of the Commercial License Terms above apply in full to your branded app instance.
10. Limitation of Liability. Our total cumulative liability to you under this Mobile App License shall not exceed the total fees you paid to us in the twelve (12) months immediately preceding the claim.
11. Governing Law. Governed by the laws of the State of Texas; disputes resolved in the courts of Tarrant County, Texas.

Effective Date: July 14, 2026

Data Processing Addendum — Commercial Subscribers
This Addendum supplements the Commercial License Terms and/or Mobile App License Terms between Your Mortgage Toolbox ("Processor") and Subscriber ("Controller") and applies to the extent Processor processes personal data on behalf of Controller in connection with the licensed services.

1. Scope. This Addendum applies only to the extent Processor processes personal data on behalf of Controller in connection with hosted calculator services or branded app instances configured for Controller. It does not apply to data Processor holds in its capacity as a Controller for its own business purposes (such as billing and account management).
2. Processor Obligations. Processor will: (a) process personal data only as necessary to provide the licensed services and in accordance with Controller's documented instructions; (b) maintain reasonable administrative, technical, and physical safeguards appropriate to the nature of the data; and (c) notify Controller without undue delay upon becoming aware of a security incident affecting Controller's personal data.
3. Subprocessors. Processor may engage subprocessors — including but not limited to Stripe (payment processing), OpenAI (Mo AI assistant), and its web hosting provider — to perform services on its behalf, and remains responsible for those subprocessors' compliance with this Addendum. Processor will provide notice to Controller before engaging a new subprocessor that will have access to Controller's personal data.
4. Deletion. Upon termination of the applicable license, Processor will delete or return personal data processed on Controller's behalf within a commercially reasonable period, except to the extent retention is required by applicable law.
5. Audit. Upon written request from Controller, Processor will provide information reasonably necessary to demonstrate compliance with this Addendum, no more than once per calendar year absent a confirmed security incident.
6. Governing Law. This Addendum is governed by the laws of the State of Texas. Any disputes shall be resolved in the courts of Tarrant County, Texas.
